By accessing or using our website https://adretro.com (the "Site") or purchasing products from us, you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully before placing an order. If you do not agree with these Terms, do not use our Site or services.
1. General
These Terms govern your use of our Site and the purchase of our vintage ad print-on-demand products. We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective upon posting to the Site. Your continued use of the Site or services after such changes constitutes your acceptance of the updated Terms.
2. Orders and Product Information
- Order Acceptance: All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including inaccuracies in product descriptions, pricing errors, or suspected fraudulent activity.
- Product Descriptions: We strive to ensure that all product descriptions, images, and prices on our Site are accurate. However, we do not guarantee that all information is error-free. Colors and designs of vintage ad prints may vary slightly due to the nature of print-on-demand production and monitor display differences.
- Pricing: Prices are listed in USD and exclude applicable taxes, shipping, and handling fees unless otherwise stated. We reserve the right to change prices at any time without notice.
3. Payment
- Payment must be made in full at the time of purchase using the payment methods provided on the Site.
- You represent and warrant that the payment information you provide is accurate and that you are authorized to use the payment method.
- All payments are processed securely through our third-party payment processor. We do not store your payment information.
4. Shipping
- Shipping Times: Estimated shipping times are provided at checkout but are not guaranteed. Delays may occur due to production times, carrier issues, or other factors beyond our control.
- Shipping Costs: Shipping and handling costs are non-refundable except as provided in our Return and Refund Policy (Section 5).
- International Orders: Customers are responsible for any customs duties, taxes, or fees imposed by their country.
5. Returns and Replacements
5.a Defective Product Policy
- 30-Day Reprint Policy: If you receive a product that is defective (e.g., damaged, misprinted, or materially different from the description), you may request a reprint within 30 days of delivery.
- Process: To request a reprint, submit a request with your order number, a description of the defect, and photographic evidence. We will review your request within 2 business days and, if approved, provide a replacement at no additional cost.
- Eligibility: This policy applies only to defects caused by production or shipping errors. Damage caused by misuse, improper handling, or normal wear and tear is not covered.
5.b Return and Refund Policy
- 30-Day Satisfaction Guarantee: If you are not satisfied with your purchase for any reason, you may request a refund within 30 days of delivery, less shipping and handling costs.
- Process: To initiate a return, submit a request with your order number and reason for dissatisfaction. You must return the product in its original condition to the address we provide. Return shipping costs are your responsibility unless the product is defective.
- Refund Issuance: Refunds will be processed within 5-7 business days of receiving the returned product, using the original payment method. Shipping and handling costs are non-refundable.
- Exclusions: Custom orders or products damaged by the customer are not eligible for refunds under this policy.
6. Intellectual Property
- All vintage ad designs and content on our Site are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our products or content without express written permission.
- Our products are licensed for personal, non-commercial use only unless otherwise specified.
7. Limitation of Liability
To the fullest extent permitted by law, AdRetro shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of our products, including but not limited to loss of profits, data, or use. Our total liability for any claim shall not exceed the amount paid by you for the product in question.
8. Disclaimer of Warranties
Except as expressly provided in these Terms, our products and services are provided "as is" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of the state of Delaware USA without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in Wilmington, Delaware under the rules of the American Arbitration Association.
